Collective Management

Following a study from DG Internal Market questioning the present structures for cross border collective management, the Commission adopted a Recommendation in October 2005 giving right holders the choice to authorize a collecting society of their preference to manage the online use of their musical works EU wide.

Latest developments During 2006, the European Parliament discussed the issue and Hungarian MEP Katalin Levai decided to work on an own initiative report, which was adopted in March 2007 in plenary. The report suggests that the Commission should work on a draft framework Directive on collective management of copyright in cross border online music services. On substance, the report recommends firstly, that competition should be encouraged, without territorial restrictions and secondly, the criteria to follow should be effectiveness and quality of service and not the level of remuneration to artists. Moreover, MEPs support pan-European license available from any collective society.

Reform of the levy system

In the beginning of 2006 the Commission included in its working programme to undertake a reform of the copyright levies applied to equipment and media used for private copying. Shortly afterwards, the Copyright Unit published a roadmap announcing that they would work on a proposal and the planned date of adoption was autumn 2006. In view of the roadmap, FEP submitted a paper together with other publishers associations on publishers’ position on levies and DRM (Digital Rights Management) in the digital world. One of the main messages in this common paper was that publishers should be able to choose freely between individual and collective management in the digital area, which can also be complementary and not exclusive to each other.

Latest developments: The Recommendation was expected to be published at the end of 2006, but finally due to political pressure, it has been ‘postponed’ without a new date for publication.
